Supreme Court Refuses to Relax Ban on Firecrackers in Delhi-NCR

The Supreme Court today declined to ease the ban on the manufacture, storage, and sale of firecrackers in Delhi-NCR, citing serious concerns over air pollution. A bench comprising Justice Abhay S. Oka and Justice Ujjal Bhuyan stated that pollution levels in the region have remained a matter of concern for a long time and relaxing the ban would not be appropriate at this stage.

The bench noted that a large section of the population works outdoors and is most affected by the rising pollution levels. It emphasized that not everyone can afford air purifiers at their homes or workplaces to protect themselves from harmful air. The court also pointed out that the basic right to clean air must be upheld and protected, especially for those who are most vulnerable.

Refusing to review its previous orders, the Supreme Court stated that unless it is fully satisfied that the so-called ‘green’ firecrackers do not contribute to air pollution, there is no reason to reconsider the existing ban. The bench expressed doubts over the environmental safety of these so-called eco-friendly crackers and said that pollution from them must be scientifically proven to be minimal before any change in the court’s stance is considered.

The court’s strict stand sends a clear message about the seriousness of the pollution crisis in the capital region. It also reinforces the importance of health and environmental protection over temporary festivities.

The ruling serves as a reminder that collective responsibility and strict measures are essential in tackling pollution, especially during the festive season when the air quality traditionally worsens.
