The country’s top court has refused to grant bail to two accused in the 2020 capital city riot conspiracy case, while providing conditional relief to five other accused. The court made it clear that all accused cannot be treated equally, as their alleged level of involvement differs from person to person.
According to the court, there is enough initial material to suggest serious charges under a strict anti-terror law against the two individuals who were denied bail. The judges observed that their alleged role appeared more central and decisive in planning, mobilization, and strategic direction of the violence. Because of this, they will continue to remain in custody.

At the same time, the court granted bail to five other accused, stating that their level of participation appeared limited in comparison. The judges stressed that the “degree of involvement” is an important factor while deciding bail applications, especially in cases involving serious national security laws.
The court also addressed the issue of delay in trial proceedings. It clarified that delay alone cannot automatically override legal safeguards built into strict laws. However, it allowed the two main accused to apply for bail again after one year, once key witness examinations are completed. Lower courts were instructed to speed up the trial process, and strict conditions were laid down for those released on bail to prevent misuse of freedom.
The decision sparked strong reactions across the political spectrum. Critics questioned the prolonged pre-trial detention and argued that bail should normally be the rule, not jail. Supporters of the decision, however, said the ruling reaffirmed that those accused of serious conspiracies cannot be treated lightly.
Overall, the judgment highlights the balance courts attempt to maintain between individual liberty and national security, especially in cases involving serious allegations and strict legal provisions.
