Supreme Court: Domestic Violence Act Applicable to All Women, Regardless of Religion or Background

In a significant ruling, the Supreme Court has reaffirmed that the Protection of Women from Domestic Violence Act, 2005, is a civil law applicable to all women in India, irrespective of their religion or social background. This ruling came from a bench consisting of Justice BV Nagaratna and Justice N. Koteshwar Singh, who emphasized that the Act aims to protect the constitutional rights of women and ensure their safety against domestic violence.

The court clarified that the 2005 Act is designed to provide more effective protection for women across all sections of society. “This Act is a variant of the Civil Code, which applies to every woman in India, irrespective of her religion or social background,” the bench stated.

The pronouncement was made in response to a petition challenging an order from the Karnataka High Court related to a domestic violence case. By reiterating the universal applicability of the Act, the court strengthened the legal framework protecting women from domestic abuse, promoting equality and justice under the law.
