The Supreme Court of India ruled that the National Medical Commission (NMC) is an organ of the government and is expected to operate in a fair and rational manner. The apex court dismissed petitions challenging a Kerala High Court order and imposed a fine of ₹10 lakh on the petitioners.
The bench, comprising Justice BR Gavai and Justice KV Viswanathan, was hearing petitions filed by the NMC and others regarding the withdrawal of approval granted to a medical college to increase its seats from 150 to 250 for the academic year 2023-24. The Supreme Court upheld the NMC’s decision, emphasizing that it was within its rights to revoke the approval if the college failed to meet the required standards.
The court stressed that the NMC, as a government body, is expected to function transparently and fairly, ensuring that medical education in India meets the highest standards. The heavy fine imposed on the petitioners serves as a deterrent against frivolous litigation and underscores the court’s commitment to maintaining the integrity of medical education in the country.
